Constance Marten and partner to be retried over death of their baby

An aristocrat and her partner will be re-tried over the death of their newborn baby, after a jury were unable to reach a verdict.

Constance Marten and Mark Gordon had been on trial at the Old Bailey accused of killing their daughter Victoria. The trial took place over five months but the jury were unable to reach to decide if they were guilty or not guilty of manslaughter by gross negligence. Today, Judge Mark Lucraft KC ruled the 37-year-old mum of five, and her 50-year-old partner would likely be in court for a trial in March 2025.

During the trial, Marten and Gordon were found guilty of perverting the course of justice and concealing the birth of a child.

They had each been charged with manslaughter by gross negligence, causing or allowing the death of a child, concealing the birth of a child, child cruelty and perverting the course of justice. The pair denied all counts and went and their trial began on January 25. Jurors began deliberating on April 30 and were discharged after more than 72 hours of deliberation.

While dismissing the jury Judge Lucraft thanked them for their "extraordinary public service". He said they would be excused from jury service for the rest of their lives.
