A sex offender in prison for the abduction and rape of a care worker has requested to be known as a woman named Claire as he prepares to apply for freedom.

Officers at HMP Edinburgh were said to be stunned to hear that Albert Caballero, 50, had demanded lipstick and eye make-up and given himself the new name.

Caballero was sentenced to eight years in jail in 2019 after he attacked a young woman who had been caring for him, locked her in his flat and raped her.

He was detained shortly after the rape in December 2018, so his eight-year sentence was backdated to that date.

But now the registered sex offender is eligible to apply to the Parole Board for Scotland to be released back into the community after serving half of his sentence.

Sources at Edinburgh’s Saughton Prison have claimed that he recently changed his name to Claire and has told other inmates that he'll be transferred to a woman's prison before his release.

The insider told the Daily Record: “There’s something about him that calls to mind Silence of the Lambs. He has mad, staring eyes and sometimes they just seem to go right through you.”

The source added: “There has been talk in the jail about the prospect of him seeking a move to be among women but, given his offence, I don’t see how anyone would risk it, even the most vociferous person in favour of self-ID.”

Caballero’s case comes amid debate over Scotland’s new gender recognition laws.

The Gender Recognition Reform (Scotland) Bill, which was halted by the UK government with a section 35 order this week, will introduce a system of self-declaration for obtaining a gender recognition certificate — allowing trans people to legally change their gender without the need for a medical diagnosis.

Opponents of the laws have raised concerns about sexual predators taking advantage of self-ID but the Scottish government have said that decisions regarding where prisoners are held are not based on a gender recognition certificate.

A Scottish Government spokesperson said: “The SPS uses comprehensive individualised risk assessments to inform decisions such as the appropriate location of transgender people in custody and not the basis of a Gender Recognition Certificate.”

A spokesperson for the Scottish Prison service added: “All decisions on the most appropriate location to accommodate someone are made on an individualised basis, informed by a multi-disciplinary assessment of the rights and needs of the individual and of others in our care.”

Long-term prisoners like Caballero are able to apply for release at half-sentence, but under laws passed in 2016 some offenders can be held until six months before the end of their sentence, if the Parole Board for Scotland believes they are not safe to release.

Caballero is reported to be preparing to apply to the Parole Board for release.
