Jamie Foxx has denied claims he sexually assaulted a woman at a rooftop bar eight years ago and said the incident "never happened".
The 55-year-old actor allegedly inappropriately touched a fan while at Catch NYC & Roof. According to the lawsuit, Foxx was asked by the alleged victim's friend if he would take a picture with her to which the star responded: "Sure, baby anything for you".
She claims he seemed intoxicated at the time. She alleged he took more pictures with her before reportedly grabbing her by the arm and pulling her into a back area of the bar where he then allegedly wrapped his hands around her waist and felt up her chest.

"The alleged incident never happened. In 2020, this individual filed a nearly identical lawsuit in Brooklyn. That case was dismissed shortly thereafter," a spokesperson for Foxx told The Mirror.

They said: "Once they are, Mr. Foxx intends to pursue a claim for malicious prosecution against this person and her attorneys for re-filing this frivolous action." A woman identified only as Jane Doe said she pulled away from Foxx when he allegedly touched her inappropriately.
In documents obtained by TMZ, the plaintiff claimed she pulled away from Foxx and noticed that a security guard at the bar watched what happened between the pair and turned away without interjecting. According to the documents, the plaintiff said the actor then continued to inappropriately touch her as he put his hand into her trousers.
She alleged that after this, her friend noticed what was happening and ran over and Jamie peeled away. She said that due to the alleged "sexual assault, abuse, assault and battery" she needed medical treatment and suffered physical pain as well as emotional distress.
The plaintiff is now in the process of suing the 55-year-old actor as well as Catch NYC & Roof and their employees for both compensatory and punitive damages. The lawsuit was reported to be filed under New York’s expiring Adult Survivors Act, which has given victims of sexual abuse a one-year window for claims that would normally be barred by time constraints. That window closes after Thanksgiving.
