Pregnant woman accused of Uber murder wants release over her 'unborn child'

A pregnant woman charged with murdering a mum in an Uber believes she should be released from jail as her "unborn child is innocent".

Natalia Harrell, 24, from Florida, US, allegedly shot and killed mum-of-three Gladys Yvette Borcela, 28 in July last year after the pair got into a furious argument during a taxi trip.

The duo had left a bar in Miami and were in a taxi driving through the neighbourhood of Brickell when just Harrell pulled out a gun and allegedly shot Borcela dead in the taxi.

Harrell claimed Borcela lunged at her during their heated argument as she feared for the safety of her baby.

The victim was pronounced dead at Jackson Ryder Trauma Centre after she died of a single gunshot wound to the torso and left arm.

The suspect has remained in jail pending her murder trial.

However, on Thursday her lawyer claimed detaining Harrell and her unborn child at Turner Guilford Knight Correctional Centre in Miami was unfair.

William M. Norris said in an emergency writ: "'UNBORN CHILD has not been charged with any crime by the State. Further, the State has placed the UNBORN CHILD in such inherently dangerous environment by placing the UNBORN CHILD in close proximity to violent criminal offenders."

He also claimed the unborn bab being stuck in jail is a violation of his rights guaranteed by the US and Florida constitutions.

Mr Norris said the "draconian confinement" was damaging the unborn child as it was depriving him of vitamins and access to specialists.

In court documents he argued the baby deserved to be free from "unlawful and illegal detention" and should not be in a dangerous environment such as a prison.

Miami-Dade Corrections officials hit back at the plea who claim all inmates are treated with professional help.

In a statement it said: "Miami-Dade County Corrections and Rehabilitation partners with Jackson Health System to provide healthcare to the inmates in our custody, and we are committed to ensuring all inmates receive professional, timely medical care and all appropriate treatment.

"We are conducting a full review of the health services offered and received to ensure that all pre-natal care being provided in our custody is appropriate."

However, the victim's mum has slammed the plea and says she won't stop until she gets justice for her daughter.

Yvette Rivera wrote on Facebook: "'Natalia Harrell Killed My Daughter. 'And Now Is Trying To Get A Get Out Of Jail Free Card.

"Where Is The Justice In Miami Florida Dade County‼️ I Will Not Fall I Will Not Fail Till This Is Resolved #JusticeForGigi."

The mum added she wants "justice for her three children."
