RISHI Sunak has given the clearest signal yet he will toughen the law to enshrine biological sex - instead of gender.

The PM has already asked the Equalities and Human Rights Commission for advice on whether he could make the change.

It would mean only biological women could access single-sex spaces like women-only hospital wards and changing rooms.

Asked if would be prepared to carry through these changes, Mr Sunak said: “You know, I've been very clear that when it comes to matters like this, biological sex is fundamentally important.

“We’ve asked for that advice. And it's something I've spoken about in the past as being important to me, and we've asked the Equalities and Human Rights Commission for advice on this particular issue.”

Mr Sunak has previously said he believes it is impossible for a woman to have a penis.

It came as Gillian Keegan confirmed the government’s review into trans issues in schools will cover whether single sex toilets should be protected.

At a conference in Doncaster for northern Tories, the Education Secretary refused to guarantee loos will stay divided by biological sex.

But amid concerns young girls could be forced to share toilets with boy who say they’re female, she insisted the matter is being looked into.

Ms Keegan said: “I can't tell you what's in the guidance - but I do know what's in it.

“It definitely does cover it. It covers it in a way that we take very seriously, single sex spaces, and you'll be getting it very quickly.”

Ms Keegan also confirmed the trans review will cover whether kids can pick their own pronouns.
